Banks Can’t Lie on Loan Modification Promises

Homeowners in distress who try to get loan modifications from their lenders have an additional frustration: bank fraud that occurs when the bank promises a loan modification and then reneges on the deal.

A ruling by the Second District Court of Appeal in Los Angeles could change loan modification fraud committed by banks: a woman who refrained from protecting her home in Bankruptcy Court after U.S. Bank promised her a loan modification, then foreclosed on the home and evicted her, has been given the green light to sue her lender for bank fraud.
