Convictions of fools in San Francisco upheld

A federal appeals court upheld the convictions of two men who victimized homeowners by promising to eliminate their mortgages.

The two, Kurt F. Johnson of Sunnvale and Dale Heineman of Union City, charged $1,000 to $3,000 to the distressed homeowners, sent letters to their lenders saying the homeowners’ loans were illegal, then recorded deeds saying the mortgages were paid off when the lenders did not respond in 10 days. They were sentenced to 25 and 21 years in prison respectively and ordered to repay their victms $513,000.

According to the Ninth U.S. Circuit Court of Appeals in San Francisco, “The record clearly shows that the defendants are fools, but that is not the same as being incompetent,” and “they had the right to represent themselves and go down in flames if they wished.”
