San Diego Man Fights JP Morgan Chase on Foreclosure – and Wins

La Jolla homeowner Kaveh Khast has accomplished something that few other homeowners in distress have done: he has won a temporary restraining order that blocks JP Morgan Chase from foreclosing on his home because they misled him when he tried to modify his loan.

Khast, like many borrowers, was told by his lender (then WaMu), that in order to qualify for a loan modification, he should stop making his monthly mortgage payments and submit the application for the loan modification, which he did and which WaMu acknowledged. But they never followed up and his loan was sold to JP Morgan Chase, which told him to . . . . submit another loan modification application. After resuming his monthly payments, JP Morgan Chase told Khast he would have to be delinquent, just as WaMu had. It was the action of both banks telling Khast he had to default that the court ruled caused him irreparable harm.
